Marcus Steward: Judge denies bond for Jupiter triple murder suspect

JUPITER, Fla. – The second man arrested in a Jupiter triple homicide on Super Bowl Sunday refused to appear in court Wednesday morning.

Marcus Jamal Steward, 25, of Riviera Beach was set to go before a judge at 9:30 a.m. for his first appearance on murder charges after he was arrested Tuesday.

The judge denied bond for Steward.

Jupiter police say DNA evidence linked Steward to the killings.

Investigators found his DNA on one of the guns used in the shooting and on gloves and a shirt found in one of the victim’s cars.

Three young people were shot and killed at the Super Bowl party on Mohawk Street in Jupiter that February night.

The police chief says he’s confident there are no more suspects on the loose, and the case is closed.

Christopher Vasata was also arrested in this case in March. He remains in jail without bond.

Charles Vorpagel: Man living at home where triple murder happened enters plea agreement

PALM BEACH COUNTY, Fla. – WEST PALM BEACH, Fla. — A man facing weapons charges, who was living at the Jupiter home where three people were murdered, has entered into a plea agreement with the United States Attorney’s Office.

Charles Vorpagel has agreed to plead guilty to possession of a firearm by a convicted felon and possession of a firearm in furtherance of a drug trafficking crime.

Vorpagel lived in the home where Kelli J. Doherty, 20, of Tequesta, Brandi El-Salhy, 24, of Gainesville and Sean P. Henry, 25, of Jupiter, were shot Super Bowl Sunday.

Marcus Jamal Steward, 25, and Christopher Vasata, 24, face charges in connection with the killings.

Defense attorneys are asking the court to allow Vorpagle to be held in federal custody in Miami because he is still a witness in the Jupiter homicides and they don’t want him near the suspects.

Vorpagel will be sentenced at a later date. One of the charges carries a maximum sentence of life in prison.

Second suspect arrested in Jupiter homicides

JUPITER, Fla. – Jupiter Police announced Tuesday the arrest of an additional suspect in the Jupiter triple homicide on Super Bowl Sunday.

Marcus Steward, 25, is charged with three counts of first-degree murder with a firearm, one count of attempted first-degree murder with a firearm, and one count of grand theft of a motor vehicle. 

Sean Henry, 26, Brandi El-Salhy, 24, and 20-year-old Kelli Doherty were shot to death during a Superbowl Sunday party on Feb. 5 on Mohawk Street in Jupiter River Estates.

A Contact 5 investigation discovered Jupiter Police believe three people were involved in the shooting. Police arrested the first suspect, Christopher Vasata for the same charges in March.

Steward was on a witness list as part of court documents in Vasata’s case. 

Deputies arrested Steward in April for resisting arrest while detectives served a search warrant on him, trying to get his DNA. The warrant said they had found Steward’s DNA on a gun discovered after the shooting.

Federal officers arrested the man renting the house on Mohawk Street, Charles Vorpagel, for cocaine possession, possession of a firearm by a convicted felon and possession of a firearm for drug trafficking.

Vorpagel is expected to in Federal Court in West Palm Beach Wednesday morning for a change of plea hearing. He pled not guilty to the three charges against him in June.

Members of the United States Marshals Service Fugitive Task Force arrested Steward without incident in Riviera Beach at 12:15 p.m.

Steward is expected to appear before a Palm Beach County judge Wednesday morning. 

Statement from Jupiter Police Chief Frank Kitzerow:

“Due to the complexity of this horrendous crime, Jupiter Police Department Detectives completed a lengthy investigation and have worked tirelessly to examine all pieces of evidence obtained from this incident. As a result, Steward was apprehended and charged today.  I would like to personally thank the Palm Beach County State Attorney’s Office, the Federal Bureau of Investigation (FBI), the Drug Enforcement Administration (DEA), the Bureau of Alcohol, Tobacco, and Firearms (ATF), and the United States Marshals Service for their assistance during this investigation.  Due to the collaborative efforts of all agencies, a dangerous individual will no longer threaten our community.  At this time, there is no further evidence to indicate any other suspects were involved in this incident; and therefore, the case is now closed,” said Chief Frank Kitzerow.

Teen helps rescue man after boat capsizes at Jupiter Inlet

JUPITER, Fla. – On Friday, a boater nearly drowned after his vessel overturned at the Jupiter Inlet.

He was rescued by none other than a 13-year old boy surfing nearby. And the whole thing was caught on camera.

Most days, you’ll find 13-year-old Sam Ruskin with his surf board.

“I’ve been surfing for 9 years,” said Sam, who surfs often with friends and family at Jupiter Beach Park.

But those surf skills were put to the ultimate test on Friday when a boat capsized from rough waters at the Jupiter Inlet, just yards away from where Ruskin was catching some waves.

 

“It’s kind of scary. If you go too far past the jetty, you can get sucked in,” Sam said of the Inlet, which has seen its share of tragedies.

Nearly a year ago, two boaters died when their vessel capsized near the Inlet.

That’s why Kevin Cadby — a local videographer and boat enthusiast — brings out his drone camera to capture boat traffic and surf when the waves are large. He posts his videos on his Youtube page and Instragram.

On Friday, Cadby captured the 20-foot boat was no match for the rough seas brought about by the wind. In the video, you can see a man without a life vest pop out of the sinking vessel.

That’s when Sam said he sprang into action.

“I paddled out to where he was, and I gave him my surfboard and paddled next to him back to shore,” he said. “He definitely would have drowned if he lost his breath or didn’t make it back to shore.”

The video has soared in popularity on Facebook in just one day, already viewed nearly over 50,000 times on two different video posts.

“I think it kind of spread like crazy. It’s kind of cool,” Sam joked.

Sam’s father, Ryan Ruskin, said he didn’t know the seriousness of the rescue until he saw the video.

“He told me what happened on Friday and then he asked what’s for dinner,” said Ryan. “I’m super proud, it’s a big deal and I didn’t know what a big deal it was until I saw the video on Sunday morning.”

Ryan said Friday’s incident highlights a real danger boaters face at the inlet.

“I’m just glad [the boater] is OK. It’s very dangerous there. If he didn’t make it out of the Inlet — there’s other boats there — he could’ve gotten sucked up into the jetty or run over,” he said.

Sam says he got a thank you from the boater but didn’t catch his name. His father hopes others will see this as an inspiration to put others first.

“To have the courage to put yourself out there like that, without thinking about it for a minute, and potentially saving someone’s life. That’s a big deal,” said Ryan. “For him to jump off his board and hand it to a stranger and save him, swim and put himself in danger — I’m very proud.”

Health advisory issued at 7 beaches in Palm Beach County

PALM BEACH COUNTY, Fla. — The Florida Department of Health Palm Beach County has posted a health advisory for seven beaches after recent sampling showed bacterial levels in the water to be in the poor range.

Affected beaches include Dubois Park, Jupiter Beach, Carlin Park, Phil Foster, Ocean Ridge, Boynton Beach and South Inlet Park.

Causes of the elevated bacterial levels that prompted the advisory are unknown but are generally associated with wildlife, heavy recreational usage, high surf from high winds and high tides or runoff following heavy rains.

Health department staff samples the beach waters at 13 locations from Boca Raton to Jupiter.

Beach water quality data can be viewed at www.flhealthpambeach.org under “beach water quality.”

JUPITER, Fla. – UPDATE: A judge has granted Uber driver Gary Kitchings $250,000 bond. It is unclear if he has bonded out of jail yet.

Could the local Uber driver accused of raping a woman he brought home from SunFest get out on bond?

That’s the question a Palm Beach County judge is currently deciding. The defendant, Gary Kitchings, is currently being held in jail without bond for the May attack.

Wednesday morning, Kitching’s defense attorney went to court to argue that Kitchings has a right to pre-trial release.

The judge’s written order should be issued sometime Thursday.

The defense is arguing that this sexual encounter was consensual. They maintain that the evidence supports their version of events. However, they also say a pending rape case out of New York
calls the victim’s and her story into question.

The state called two officers involved in the case to the stand. Both testified about her report of the rape and the fact that the alleged victim was traumatized.

However, Kitchings’ defense maintains that the encounter was consensual, and pointed out that while the victim claims part of the assault took place in the car, the physical evidence doesn’t match that.

The defense also pointing out that the woman who accused Kitchings is also the alleged victim in another rape case pending in New York.

The two cases have similarly disturbing details, according to the defense.

“In this case she is alleging that, there is kind of, some strange sexual activity occurred. Had I known that there was some strange sexual activity that occurred in the New York case as well, I would have confronted her with exactly the things that were stated,” said public defender Stephen Arbuzow.

According to Abruzow and a New York Post article, the woman met her alleged attacker through a “sugar daddy” app called “Seeking Arrangements,” which claim that she was working as an “S&M prostitute.”

Abruzow claims the woman was not forthcoming about that during her initial deposition.

Which is why they also argued Wednesday that they should get a second chance to question the victim under oath.

The judge agreed but made it clear the attorney could only ask about the New York case.

5 hurt in crash on Florida’s Turnpike near Indiantown Road exit in Jupiter

JUPITER, Fla. – All southbound lanes of Florida’s Turnpike are back open Thursday after a wreck near the Indiantown Road exit in Jupiter.

The rollover crash involving a truck occurred around 11 a.m., injuring five people.

Palm Beach County Fire Rescue said all five people, which included two adults and three children, were transported to a local hospital for treatment.

It’s unclear what caused the wreck.

JUPITER, Fla. — A Jupiter man is facing drug and assault charges after police say he threatened someone with a gun.

On Monday, November 6, 2017, a Jupiter police officer was on routine patrol on South A1A just before 4 p.m.

The officer observed a large group of people standing in the roadway yelling at each other.

One of the people waved his arms at the officer to get him to stop. While the officer stood on the driver’s side of his patrol car, he heard one of the people say “He’s got a gun”. At the same time, the officer observed several people running into the bushes.

One of the men, identified as Jose Vazquez, stated he was at the beach with several friends when a man, later identified as Devardo Cooper, drove by them in a black Impala while they were on the sidewalk.  Vazquez said he and Cooper got into a verbal argument over his cousin’s ex-girlfriend.

According to Vazquez, Cooper pulled out a black handgun from a backpack he was carrying. Vazquez said as soon as Cooper pulled out the gun, Cooper saw the police patrol car driving by. Vazquez says Cooper gave the backpack to one of his friends and told him to run with it.

A man identified as Carlos Franco was found walking on A1A who matched the description of the person running into the bushes with the backpack.

Both Franco and Cooper were placed under arrest and transported to the Jupiter police department.

Devardo Canute Cooper is charged with Aggravated Assault with a deadly weapon without the intent to kill and multiple drug possession charges.

Jupiter Amber Alert case closed with no arrests, interrogations reveal Step-grandmother took boy

JUPITER, Fla. – Police files released on the Jupiter Amber Alert issued for a 4-year-old boy in August reveal that the nanny arrested for his abduction was never involved in his disappearance.

The State Attorney’s Office dropped charges against the nanny, Blanca Castro, in September. Now, we know why.

While providing her statement to police, the boy’s step-grandmother, Elizabeth Caprio, told the detective that she and her sister took the child. 

Caprio told police she had organized an intervention after she suspected that the boy’s mother, her step-daughter Danielle Caprio, may have relapsed. She cancelled her business trip to Tampa and drove to Jupiter, having her sister meet her at the Jupiter townhome where Danielle and the boy were living, a home owned by Elizabeth and Louis Caprio.

Caprio said at the home, she discovered a suitcase with men’s clothes belonging to a man that she and her husband had told Danielle to stay away from. Castro had also told the Caprios she was afraid of this man who she believed Danielle was dating. Elizabeth Caprio then told Castro to pack her things and leave, while the child was out with Elizabeth’s sister. 

When Danielle came home she said her son was gone and so was the nanny. She started to call the nanny and her father, but no one answered so she called police. 

For hours police tried to contact the Caprios when the boy’s mother told them she feared the nanny took him on her father’s orders. 

The detective on the case said Louis Caprio would not call her back and when he did, he only told them Dominic was safe. When police told him it was illegal to take the child, the police report said he told them ‘do what you have to do.’ 

While making a statement to police after the boy was returned, he explained his actions.

“I did tell you Dominic is safe and I though, I said Liz, this is no longer about Dominic, this is going to become about you and me and I could feel that. And I knew I probably needed to talk to somebody and I should have, but I didn’t know if I said something to you, it could have gotten myself or my wife in trouble,” said Louis Caprio to the detective. 

“If you had just done it the right way. That’s what’s so frustrating,” said the detective. “You did it wrong.” 

“Truthfully, I had visions of police coming and grabbing Dominic,” Elizabeth said.

During her interview with police, Elizabeth Caprio told the detective she left the boy’s mother a note saying she had the boy. The detective said there was no note provided to them.

The boy’s return was coordinated through the Caprios’ attorney Douglas Duncan. The Jupiter Police Department has not said why no one is facing charges. 

Police reports cite State Statute 787.03(4)(a), it is a viable defense, for the interference of custody/kidnapping statutes, that the defendant had reasonable cause to believe that his or her action was necessary to preserve the minor or the incompetent person from danger to his or her welfare.

JUPITER, Fla. – From about 50 candidates, down to one. The town of Jupiter has picked out its next manager. 

The Jupiter town council voted unanimously to negotiate a salary and benefit package with Matt Benoit. 

Benoit is currently the city manager of Huntsville, Texas. 

If an agreement is reached, the council will have to take a final vote before Benoit can start the job.

PALM BEACH COUNTY, Fla. — Two left lanes of I-95 southbound were blocked near Donald Ross Road at mile marker 86 due to a tractor trailer crash on Saturday.

The crash left a tractor trailer on its side and facing the wrong direction. 

Crews worked for a few hours to clear the scene.

All lanes have reopened.
